Terms and Conditions

Tata Sky subscribers participating in the Promotion shall be bound by the following terms and conditions:

Definitions

1. “Promotion Period” means the period of the Promotion from 00:00 hours on 19 November 2009 till 23:59 hours on 30 November 2009
2. “Recharge” means a Tata Sky account recharge done by You in a single transaction during the Promotion Period on the Tata Sky Helpline (IVR) using your credit card or the Atom mobile application.

Terms used herein but not defined shall have the same meaning as assigned to them in the Subscription Contract signed between You and Tata Sky.

Eligibility

1. The Promotion is open ONLY to Tata Sky subscribers performing a Recharge.
2. Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate.
3. You must (i) be a resident of India and (ii) be above 18 years of age

Product

1. During the Promotion Period, Tata Sky subscribers who Recharge will have the option of purchasing a Polo Watch worth Rs 3,850, at a special discount price of Rs 499.
2. Once payment for the Polo Watch from the Tata Sky subscriber is confirmed then the merchant will send the Polo Watch to the Tata Sky subscriber within 15 days of the payment. The Polo Watch shall be delivered to the Tata Sky subscriber at the address as per the Tata Sky records. Tata Sky shall not be liable for delayed delivery or any damage caused to the Polo Watch during delivery. In the event of damage caused to the Polo Watch during delivery, the Tata Sky subscriber(s) must take up this matter directly with the merchant. Tata Sky shall not be liable for any defect or deficiency in the Polo Watch. You acknowledge that the Polo Watch is provided by an independent merchant and You agree to contact the merchant directly for any quality, repair or warranty related issues. 

General

1. Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this Promotion or to withdraw it completely.
2. Tata Sky will not be liable for any loss, damage or cancellation of this Promotion caused by events beyond its reasonable control including war, natural calamities, floods, failure of telecommunication network, etc.
3. You consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Promotion including but not limited to Purchase of the Polo Watch by the Subscriber.
4. You acknowledge and agree that all disputes in relation to the Promotion shall be subject to Delhi jurisdiction.
5. Tata Sky is not responsible for printing or typographical errors in any Promotion related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error.
6. The Promotion is void where prohibited or restricted by law, and is subject to all applicable mandatory national, state and local laws.
